These Terms of Service ("Terms") govern your use of gotbetter.co and the services provided by Got Better ("Got Better", "we", "us", or "our"). By accessing the site or using our services, you agree to these Terms. If you do not agree, please do not use the service.
Got Better is a matching service that connects Y Combinator startups ("Clients") with senior product designers ("Designers"). We help identify and introduce Designers who fit your brief. Got Better facilitates the introduction and the working relationship, but the design work itself is performed by the Designer.
You must be at least 18 years old to use the service. If you use the service on behalf of a company or other organisation, you represent that you have the authority to bind that entity to these Terms.
If you apply to join Got Better as a Designer, you represent that the information and work you submit is accurate and yours to share, and that you have the right to be engaged for the work. Acceptance onto the roster is at our discretion. The terms of any individual engagement between a Designer and a Client are set out in the applicable engagement or agreement for that project.
The Got Better name, site, and its content are owned by Got Better and protected by applicable laws. You may not copy, modify, or use them except as allowed by these Terms. Ownership of deliverables created by a Designer for a Client is governed by the agreement for that specific engagement, not by these Terms.
You agree not to misuse the service, including by: breaking the law, infringing others' rights, attempting to circumvent our matching to avoid fees, submitting false information, uploading harmful code, scraping or overloading the site, or harassing other users. We may suspend or remove access for conduct that violates these Terms.
The service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, and any warranty regarding a specific result, match, or business outcome. We do not warrant that the service will be uninterrupted or error-free.
To the maximum extent permitted by law, Got Better and its founders will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the service. Our total liability for any claim relating to the service will not exceed the amount you paid to us in the three months before the event giving rise to the claim.
You agree to indemnify and hold harmless Got Better and its founders from claims, losses, and expenses (including reasonable legal fees) arising from your misuse of the service, your violation of these Terms, or your infringement of any third party's rights.
You may stop using the service at any time. We may suspend or terminate access if you breach these Terms or if we discontinue the service. Sections that by their nature should survive termination (such as intellectual property, disclaimers, limitation of liability, and indemnification) will continue to apply.
These Terms are governed by the laws of India, without regard to conflict-of-law rules. Any disputes will be subject to the courts located in Rajasthan, India, unless applicable law requires otherwise.
We may update these Terms from time to time. When we do, we will change the "Last updated" date above. Your continued use of the service after changes take effect means you accept the updated Terms.
